5. Exemptions

HIE's aim is to be as open as possible. However, there may be circumstances in which we believe information should be exempt from being made publicly available, which are detailed in our exemption policy. If you wish to read the exemption policy, please see class 2.5 regarding policies on accessing our information.

Information in this scheme may be withheld from any of the classes of information listed in the publication scheme where we consider that disclosure may substantially prejudice the effective conduct of our public affairs, or legal proceedings, or where the disclosure is otherwise prohibited by law. We may withhold information if its disclosure would breach the law of confidentiality or seriously prejudice the commercial interests of any person or organisation. We may also withhold information which is personal information under the Data Protection Act 1998.

In these cases, we will withhold the information and indicate why the information is being withheld. If you wish to complain about the information which is being withheld from you, please read the scheme's complaints section in accessing information

6. Archiving policy

HIE has an archiving policy in addition to retention and destruction schedules for all records held. The above policies are listed in the sub-class managing information in the policy class (2.5) of this scheme.

7. Copyright

The majority of information obtained from this publication scheme can be copied or reproduced without formal permission provided it is copied and reproduced accurately, is not used in a misleading context and provided that the source of the material is identified and the copyright status acknowledged.

Some information contained in this scheme is subject to copyright legislation and therefore cannot be reproduced without prior permission from HIE. The classes are annotated accordingly where this is the case.
